Welcome to the boring (but important) bit. Below you'll find the Terms & Conditions and Privacy Policy for Captain Jelli's Swim School. Please read them carefully — by enrolling your child, or yourself as an adult participant, you agree to be bound by them.

Terms & Conditions

These Terms & Conditions ("Terms") govern your enrolment in swimming lessons with Captain Jelli's Swim School Ltd ("Captain Jelli's Swim School", "we", "us", "our"), a company registered in England and Wales under company number 17288595. By enrolling your child, or yourself as an adult participant, in lessons with us, you ("you", "the parent/guardian/participant") agree to be bound by these Terms.

1. PARTICIPATION POLICY

1.1 Parent & Child Group Classes and Private Lessons with an Adult Participant in the Pool

Parents or guardians are fully responsible for their children during the class and must follow the instructions provided by the instructor at all times. Failure to follow these instructions may result in injury.

1.2 Independent Swimming with no parent present in the water

Children are expected to adhere to Captain Jelli's Swim School's Behaviour Policy (Section 2) to ensure their safety during the lesson. Teachers are responsible for students only during the allocated lesson time. We are not responsible for incidents that occur outside of this time, save where caused by our negligence.

2. BEHAVIOUR POLICY

All students are expected to behave appropriately during lessons, respecting instructors and other participants. Behaviour such as spitting, hitting, kicking, screaming, or other unsafe conduct will not be tolerated and may result in a student being removed from a class. No refund will be given for a lesson missed as a result of removal under this policy. Jewellery must not be worn in the pool.

3. MEDICAL CONDITIONS, ACCIDENTS AND INJURY

3.1 Medical Disclosure

You confirm that your child is in good health and does not have any medical condition that would prevent safe participation in swimming lessons. You agree to inform us in writing of any medical conditions, allergies, or physical limitations before lessons begin, and to keep us updated if anything changes.

3.2 Inherent Risk

Swimming and aquatic activities involve inherent risks. By enrolling, you acknowledge and accept these inherent risks.

3.3 Our Liability

Captain Jelli's Swim School holds appropriate swim school insurance and operates documented Normal Operating Procedures and Emergency Action Plans (see Section 14). Our lead teachers hold their own personal insurance, current DBS checks, safeguarding training and relevant teaching qualifications.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be excluded or limited under English law. Subject to that, we do not accept liability for accidents, injuries or illness arising from inherent risks of swimming, from your child's own actions, or from non-compliance with instructor directions or the Behaviour Policy, except where this results from our negligence or breach of these Terms.

4. SUPERVISION

For lessons involving younger children, you agree to ensure a responsible adult is present at the facility. We are not responsible for supervision outside the designated lesson time.

5. SWIMMING EQUIPMENT

Swim gear (including swimwear, goggles, and flotation devices) should be appropriate and in good condition. Any incident caused by a fault in personal equipment should be raised with the manufacturer. We are not liable for damage to, or loss of, personal belongings, except where this results from our negligence.

6. PHOTOGRAPHY AND MEDIA

We may take photographs or video footage of participants during lessons for promotional purposes (including our website and social media). We will only do this with your prior written consent, given at the point of enrolment or separately. You may withdraw this consent at any time by notifying us in writing, and we will stop using new images of your child from that point and remove existing promotional material within a reasonable time where practicable.

7. ILLNESSES AND INJURIES POLICY

For the safety of all swimmers, children must not attend lessons while experiencing any of the following, until fully recovered (and, where indicated, cleared by a medical professional):

• Fever within the past 24 hours

• Flu-like symptoms (sore throat, congestion, runny nose)

• A barking cough and/or croup

• Ear infections (active or recent)

• Conjunctivitis (pink eye)

• Diarrhoea or vomiting within the last 48 hours

• Contagious skin conditions (e.g. impetigo, chickenpox, ringworm)

• Open wounds that are not fully healed or properly covered

• Active cold sores

• Strep throat, or within 48 hours of starting antibiotics for it

• Respiratory infections, or asthma symptoms that are not under control

• Any contagious disease (e.g. flu, COVID-19, hand, foot and mouth disease)

• Injuries to limbs or joints that may hinder mobility or require special care

• Recent surgery or dental work requiring rest

• Severe allergies that could trigger a reaction in water

• Severe migraine, severe fatigue, or dehydration

• Any condition requiring special medical equipment (e.g. a cast)

• A recent head injury, concussion, or spinal injury

• Dizziness or motion sickness affecting balance in water

If you are unsure whether it is safe for your child to attend, please consult a doctor before bringing them to a lesson.

8. DIRECT DEBITS AND PAYMENTS

Lessons are paid by Direct Debit, collected via GoCardless and managed through our booking platform, Membermeister. Direct Debit amounts are calculated pro rata across the year, so payments continue at the same level through holiday periods. Current pricing is set out in our published price list at the time of enrolment.

9. MISSED PAYMENT POLICY

First missed payment: no penalty is applied.

Second missed payment: a £5 administration charge applies. We will issue an invoice for the amount owed plus the £5 fee, which must be settled within 48 hours to retain your child's place.

Third missed payment: your Direct Debit will be cancelled and lessons must then be paid termly in advance. If payment is not received by the start of term, the place will be released.

If you anticipate difficulty making a payment, please contact us before it is missed – we're happy to discuss this.

10. CANCELLATION OF MEMBERSHIP

We require 28 days' written notice to cancel your membership. Any unused lesson credits at the time of cancellation will be deducted from the notice period (for example, two lesson credits reduce the notice period by two weeks). The final Direct Debit payment falling within the notice period remains payable.

Failure to provide the required notice may result in ineligibility for re-enrolment. We do not offer refunds where a lesson credit or catch-up session can instead be arranged. If you are experiencing financial difficulty, please contact us – we will treat this sensitively and discuss options.

11. IF YOUR CLASS IS CANCELLED

We make every effort to avoid cancelling lessons. For the safety of our younger swimmers, parent-and-child classes only run in pools maintained at 29°C or above; if the pool falls below this, the lesson will be cancelled and we will arrange a catch-up where possible. If you cannot attend the catch-up, or one cannot be arranged within a reasonable time, a lesson credit will be added to your account.

Once you have accumulated four lesson credits, these will cover your final payment when you give notice to cancel. If you hold more than four credits, you may use the surplus against future lessons.

We treat our staff with respect and ask that you do the same. Aggressive or abusive behaviour towards staff may result in immediate termination of membership without refund.

12. WHAT TO EXPECT ON POOLSIDE

For classes involving children aged 4 and over (excluding 1-to-1 private lessons), parents do not enter the pool; children are supervised by their teacher and assistant. Please arrive no more than 5 minutes before your lesson and wait for the teacher to collect your child from poolside. You must remain in the building throughout the lesson; spectating from poolside during the lesson itself is not permitted. Please return to poolside 2–3 minutes before the lesson ends, and we will bring your child back to you safely.

Our lessons follow our own award framework and we do not use armbands, as these can hinder development in the water; we may use aids such as noodles or fins where appropriate. Please bring goggles to lessons.

All our lessons are child-led; we will never force a child to do something they are uncomfortable with. Unsafe or dangerous behaviour will not be tolerated and may result in a child being removed from a lesson. Private 1-to-1 lessons are available subject to availability.

13. INCLUSIVITY

Captain Jelli's Swim School is an inclusive swim school, welcoming children and adults of all abilities. We offer group and private lessons tailored to individual needs, including for children with additional needs such as autism or ADHD, who are welcomed into our mainstream classes provided they are able to follow our safety instructions. Where a child holds an Education and Healthcare Plan (EHCP), we kindly ask that a copy is provided before lessons begin so that we can support them appropriately.

14. PROCEDURES AND POLICIES

This document summarises our key customer-facing policies. We maintain a fuller suite of operational policies, copies of which are available on request, including:

We review these policies regularly to maintain a high operating standard.

15. COMPLAINTS

If you are unhappy with any aspect of our service, please contact us at swimatcaptainjellis@gmail.com in the first instance. We will acknowledge your complaint within 5 working days and aim to resolve it within 28 days. If you remain dissatisfied, you may escalate the matter as set out in our Complaints Procedure, available on request.

16. GENERAL TERMS

Entire agreement: These Terms, together with our published price list and any policies referred to in them, form the entire agreement between you and Captain Jelli's Swim School Ltd.

Changes to these Terms: We may update these Terms from time to time. We will give at least 28 days' notice of any material change before it takes effect.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.

Governing law: These Terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, save where you live in Scotland or Northern Ireland, in which case local mandatory consumer protections will also apply.

17. PRIVACY POLICY

At Captain Jelli's Swim School, we are committed to protecting your privacy and handling personal data responsibly, in compliance with UK GDPR and the Data Protection Act 2018.

17.1 Data We Collect

When you register for lessons, we may collect:

• Name, address and contact details (phone number, email address)

• Payment information, for Direct Debit collection

• Health and emergency contact information, for your child's safety

17.2 How We Use Your Data

We use your data to provide swimming lessons and related services; to communicate with you about progress, scheduling and updates (including via WhatsApp and other messaging platforms where you've agreed to this); to process payments and manage membership; and to ensure the safety and wellbeing of participants during lessons.

17.3 Lawful Basis

We process most of this data under contract (to provide the lessons you've booked) and legitimate interests (running the business safely). Where we use images or video for promotional purposes, or contact you for marketing, we rely on your consent, which you may withdraw at any time.

17.4 Third Parties

We share data with the following trusted providers, each of whom is contractually required to handle data in line with UK GDPR:

• GoCardless – processes Direct Debit payments

• Membermeister – manages bookings, scheduling, and customer communications

• Social media platforms (e.g. Facebook, Instagram) – only where you have given consent to promotional use of images

17.5 Data Security and Retention

We take reasonable technical and organisational steps to protect personal data against unauthorised access, use or disclosure. We retain personal data only for as long as necessary to provide our services or as required by law (for example, financial records are typically kept for 6 years for tax purposes), after which it is securely deleted.

17.6 Your Rights

You have the right to access the personal data we hold about you, correct inaccuracies, request deletion (subject to our legal obligations, such as financial record-keeping), object to or restrict certain processing, and withdraw consent for marketing or promotional use of images at any time. You also have the right to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk if you believe your data has been mishandled.

By enrolling your child, or yourself as an adult participant, with Captain Jelli's Swim School, you consent to the collection and processing of personal data as described in this policy.

18. TERM DATES

Term 1 2026/27: commencing 7 September 2026 – 25 October 2026

Half term: 26 October 2026 – 8 November 2026

Term 2 2026/27: commencing 9 November 2026 – 20 December 2026

These dates may be affected by bank holidays; catch-ups and credits will be offered where lessons are missed as a result.
